		<title><![CDATA[[NCDOI_Engineering] Update on NC Code Effective Dates and Standard Code Classes]]></title>

		<description><![CDATA[Based on the outcome of the December 12, 2011 meeting of the NC Building Code Council, the mandatory effective date for the 2012 Building, Fire, Mechanical, Fuel Gas, and Plumbing codes is now June 1, 2012.  The effective date for the Energy Conservation and Residential Codes was initially to coincide with the rest of the Codes but per 2011 Legislative SL 2011-269 their mandatory effective dates will remain March 1, 2012.<br />

With this, we will move forward with the following enforcement dates:<br />

The Residential code will now have the residential portions of the Mechanical, Plumbing and Electrical printed in it as mandated by the BCC. This will push the size of the book beyond 1000 pages and increase the cost substantially. The residential text from the original codes (i.e. mechanical/plumbing/electrical) will be duplicated for the residential printing.<br />

When all of the codes have been proofed and formatted, ICC will begin providing the electronic version of the codes to the jurisdictions.<br />
 <br />
While we have asked ICC to expedite the printing of the code books, there is no guarantee we will get them before March 1st. We suspect we will see the Energy Code before March, but do not have the same confidence for the residential code due to the expansion to include the trades in the same book. <br />
 <br />
There is always a possibility that some of these dates may change again, though, at this point, we do not expect that to happen.  If it does occur, we will let you know as soon as possible. <br />

Standard Code Classes (for Code Enforcement Inspectors)<br />
 <br />
Although the mandatory start date for the Energy and Residential Codes remains March 1st, the actual Code books are not anticipated to be available by that date.  As a result, all Standard Code Courses with an end date from January 2012 through March 2012 will utilize the 2009 Code in all areas except Electrical.  PowerPoints for the 2012 Code will be available after the first of the year and before April 2012 for use in courses taught beginning April 2012.<br />

We will send out another update regarding test updates to the new Code editions immediately following the January 24th Qualifications Board meeting.  In the meantime, please advise your students that if they want to test to the current 2009 Code editions they need to schedule a test ASAP.]]></description>

Some of you may know that the BCC had recently changed the effective dates of all the codes to June 1, 2012. However right before Christmas, our attention was brought to SL 2011-269 which specifically states that the effective date of the Residential Code and the Energy Code is required to be March 1<sup class='bbc'>st</sup>, 2012.<br />
<br />
With this, we will move forward with the following enforcement dates:<br />
<br />
Building, Fire, Plumbing, Mechanical, Fuel Gas and Administrative – June 1, 2012<br />
Residential and Energy Conservation – March 1, 2012<br />
Electrical – Most likely August 2012 based on recent comments made by majority members of the BCC to staff to insert the 2011 NEC - despite Legislative Review.<br />

		<title><![CDATA[Dryer Duct 'Lint Trap']]></title>

		<description><![CDATA[Here are some picture of a lint trap that an inspector of mine came across.  The HVAC contractor sears he was told to install a lint trap into the dryer duct at a seminar he went to.   The trap is totally closed and would be encased in the drywall with no way to clean it out.  Can anyone say "house fire"?<div id='attach_wrap' class=''>

Employees at this level receive only occasional instruction or assistance as new or unusual situations arise, and are fully aware of the operating procedures, and policies of the work unit. </span><br />

<span style='font-size: 8px;'>1. Perform mechanical inspections of industrial, commercial and residential buildings during various stages of construction and remodeling to ensure compliance with all applicable mechanical laws and codes. </span><br />
<span style='font-size: 8px;'>2. Interpret mechanical codes for the public, city staff, contractors, architects and building owners. </span><br />
<span style='font-size: 8px;'>3. Answer questions and provide information regarding mechanical codes and related issues; investigate complaints and recommend corrective action as necessary to resolve complaints. </span><br />
<span style='font-size: 8px;'>4. Review, approve or reject construction plans and specifications to ensure compliance with mechanical codes. </span><br />
<span style='font-size: 8px;'>5. Confer with inspectors from other departments and divisions to ensure consistent code and ordinance enforcement. </span><br />
<span style='font-size: 8px;'>6. Prepare letters and notices to tenants and homeowners of structures needing mechanical repair work. </span><br />
<span style='font-size: 8px;'>7. Prepare daily reports of inspections performed and results of inspections. </span><br />
<span style='font-size: 8px;'>8. Verify the licensing and registration of mechanical personnel at construction sites; maintain records of licensed mechanical personnel. </span><br />
<span style='font-size: 8px;'>Secondary Duties 1. Attend and participate in professional group meetings, seminars and conferences; stay abreast of trends and innovations in the fields of plumbing, gas, heating, air conditioning and refrigeration. 2. Perform other duties as assigned. </span><br />
<span style='font-size: 8px;'>Any combination of experience and training that would likely provide the required knowledge and abilities is qualifying. A typical way to obtain the knowledge and abilities would be: Experience: One year experience performing HVAC inspections or two years experience installing mechanical systems. Education: High school diploma or equivalent supplemented by additional specialized training in plumbing or HVAC or a related field. Licensing & Certifications Possession of, or ability to obtain, an appropriate valid driver's license. 		<title>Return-air grilles</title>

		<description><![CDATA[There is nothing in the code that sizes a return-air grille other than the 450 fpm that is found in section 603.18 (2012 NCMC).<br />

I propose that a section be added to the code per the following:<br />
 <br />
<em class='bbc'><strong class='bbc'>"The minimum size of return-air grilles shall be 1 square inch per 2 cfm of air flow."</strong></em><br />
 <br />
This gives the inspector a minimum size and the 1 SqIn per 2 cfm is the industry accepted standard to size return-air grilles.<br />
 <br />
For instance, a 2 1/2 ton AC system has approximately 1000 cfm air flow.  Based on the statement above, a 500 SqIn return-air grille would be required.  Any combination or number of grilles that equal or exceed the requuired size would be acceptable.<br />

		<title>NCMC 604.4 foam plastic insulation</title>

		<description>There have been some instances where contractors who serve states adjacent to North Carolina are being supplied with foam plastic insulation for ductwork that does not meet section 604.3 and 604.4.  The IRC has a less restrictive requirement and they are under the impression that this is also allowed in North Carolina.  The North Carolina Codes require a flame spread index of not more than 25 and smoke developed index of not more than 50 in accordance with ASTM E 84.</description>

<em class='bbc'>I am writing today based on some comments and feedback I received while I attended the North Carolina Mechanical Inspectors Association meeting on Aug 15-17 in Atlantic Beach NC. As I understand it there are 2 main issues they wanted me to assist them with. The first is that approximately 3 years ago ICC offered a North Carolina Certification conversion to ICC Certifications. Unfortunately, this was at a time when the economic landscape for code enforcement staff was not very stable and many code officials were unsure about the security of their employment positions. As I understand it, the cost to many of these code officials, to convert certifications, was about $600.00. With their employment future unstable, it was not practical or economically feasible for many of the NC code enforcement community to make the certification conversion investment. So they wanted me to ask if there was any way possible that ICC training and certification would consider opening that conversion window of opportunity again?</em><br />
 <br />
<em class='bbc'>Secondly as I listened to several discussions it became apparent that there seems to be a fairly large communication disconnect. Several of their members expressed that they had been taking certification exams and have experienced the following:</em><ul class='bbcol decimal'><li><em class='bbc'>Certification tests were impossible to pass. One locality has 2 staff that are recent college graduates and even they have not been able to pass the test.</em><br /></li><li><em class='bbc'>The grading scale does not make any sense and appears to be unfair.</em><br /></li><li><em class='bbc'>They no longer receive a breakdown of the test results when they don&#8217;t pass. Therefore they do not know what areas they need work in. </em></li></ul>
<em class='bbc'>Some of the conversations were not clear to me if this is an ICC issue or a NC state issue. For example one member told me that he appealed to ICC when he took an exam and failed by 1 point. He said the advertised test break down said there were 25 questions on the topic of Administration but his test had 89 questions on Administration. He said ICC heard his appeal and denied it. But later NC heard his appeal and approved it and he received a passing score. This didn&#8217;t make any sense to me. I wasn&#8217;t aware that ICC test had that many questions which led me to believe this was a state issue. But he said ICC heard his appeal and denied it. So I was totally confused on this one. </em><br />

<em class='bbc'>When they talked about not getting a breakdown of results I thought this was a state issue as well because I do not ever recall ICC offering a breakdown of the areas I thought it was always just pass or fail. </em><br />

 <br />
I would like to address the second set of issues that you raised in your email. I think it would probably be helpful to you if I explained how the certification exams are developed in North Carolina.<br />
 <br />
A committee of level III NC certified Code Enforcement Officers is convened. The members of that committee are pulled from across the state &#8211; mountains to the sea &#8211; and from a broad range of experience. One or two are licensed engineers or architects, most started out as Level I inspectors and worked their way up. Some are directors of inspection for their jurisdiction. These highly qualified individuals get together and draft test questions in a format presented to them by the psychometricians with ICC. They then review those questions and assign a cut score for each certification level by determining how many minimally competent inspectors at that level will know the answer on their first day of work. (Note I said &#8220;will&#8221; and not &#8220;should&#8221;.) Each committee member assigns a score to each question and the final cut score is taken as the average. This average is used for the &#8220;scaled&#8221; score.<br />
When an applicant takes the exam developed by the committee, they are provided a pass/fail result. If they failed within 10 points they are allowed to schedule a review session and challenge any question they feel is incorrect or unfair. The initial challenge is responded to by the testing staff at ICC. If the applicant disagrees with the results of that initial challenge, they can challenge again. This review goes directly to the same exam development committee that wrote the exam &#8211; NC certified inspectors.<br />
The tests are reviewed annually by ICC psychometricians to determine any inconsistencies between the cut scores set by the committee and the actual results. Any problem questions are referred back to committee or removed from the test bank. We have had some difficulty with this process only because some exams are being taken so infrequently that we have trouble getting a statistically significant set of results. But we continue to monitor results.<br />
Now to the specific items you listed.<ul class='bbcol decimal'><li>The certification tests are not impossible to pass. In the last quarter (April to July) we had 160 people take exams and 118 passed. But every test had individuals pass within the last quarter. For mechanical specifically the passing scores were: MI &#8211; 100%, MII &#8211; 87.5%, MIII &#8211; 55.6%.<br /></li><li>The grading scale has been reviewed in depth by the Qualifications Board several times. ICC has sent staff to explain the process and the Board has voted to continue with scaled scores. Because we cannot offer each test taker the same questions on their exam for security reasons, there is no better way to guard against one individual getting an easy test and a second individual getting a hard test. Scaling does nothing but attempt to level that playing field.<br /></li><li>The letter that the test takers receive if they fail an exam does have a generic breakdown of topics and how they performed on each. In the past, test takers were able to review all test questions regardless of their score. This exposure of the test questions is unacceptable for testing security.</li></ul>
I want you to understand that the certification testing in NC has changed considerably in the last few years. These changes were very necessary in order to move towards a more accurate and legally defensible exam, but they have left some of our veteran inspectors wary. Change is always unsettling. But, the Board has not abandoned the inspectors. They monitor and approve any change that&#8217;s been made, the test results are presented at every Board meeting, and they even hear a summary of any complaints staff has received about the process. Board staff is always available to applicants who have concerns.<br />
 <br />

AN ACT TO EXPAND THE EXEMPTION FROM BUILDING RULES FOR FARM <br />
BUILDINGS TO INCLUDE FARM BUILDINGS USED FOR SPECTATOR EVENTS.<br />
The General Assembly of North Carolina enacts:<br />
SECTION 1.  G.S. 143-138(b4) reads as rewritten:<br />
"(b4) Building rules do not apply to (i) farm buildings that are located outside the <br />
building-rules jurisdiction of any municipality, or (ii) farm buildings that are located inside the <br />
building-rules jurisdiction of any municipality if the farm buildings are greenhouses. For the <br />
purposes of this subsection:<br />
(1) A "farm building" shall include any structure used or associated with equine <br />
activities, including, but not limited to, the care, management, boarding, or <br />
training of horses and the instruction and training of riders. Structures that <br />
are associated with equine activities include, but are not limited to, free <br />
standing or attached sheds, barns, or other structures that are utilized to store <br />
any equipment, tools, commodities, or other items that are maintained or <br />
used in conjunction with  equine activities. The specific types of equine <br />
activities, structures, and uses set forth in this subdivision are for illustrative <br />
purposes, and should not be construed to limit, in any manner, the types of <br />
activities, structures, or uses that may be considered under this subsection as <br />
exempted from building rules. A farm building that might otherwise qualify <br />
for exemption from building rules shall not be exempt if it is used for a <br />
spectator event and more than 10 members of the public are present at the <br />
farm building for the event.A farm building that might otherwise qualify for <br />
exemption from building rules shall remain subject only to an annual safety <br />
inspection by the applicable city or county building inspection department of <br />
any grandstand, bleachers, or other spectator-seating structures in the  farm <br />
building.  An annual  safety inspection shall include an evaluation of the <br />
overall safety of  spectator-seating  structures as well as  ensuring the <br />
spectator-seating structure's  compliance with  any  building codes related to <br />
the construction of spectator-seating structures  in effect at the time of the <br />
construction of the spectator-seating.<br />
(2) A "greenhouse" is a structure that has a glass or plastic roof, has one or more <br />
glass or plastic walls, has an area over ninety-five percent (95%) of which is <br />
used to grow or cultivate plants, is built in accordance with the National <br />
Greenhouse Manufacturers Association Structural Design manual, and is not <br />
used for retail sales. Additional provisions addressing distinct life safety <br />
hazards shall be approved by the local building-rules jurisdiction."Page 2 H329 [Ratified]<br />
SECTION 2.    This act is effective when it becomes law and applies to all farm <br />
buildings, including farm buildings where construction either began or was completed prior to <br />
the effective date of this act.<br />

		<description><![CDATA[As of today, I have set the user permissions so that a user must first register on the forums with a valid password before they can post messages.  An unregistered user may still read parts of the forums but will be unable to post.<br />
<br />
I had to do this because of SPAM.  I was having to delete several messages a week related to porn or just plain SPAM postings.<br />
